Provincial Nominee Program

PROVINCIAL NOMINEE PROGRAM (PNP)

Provincial Nominee program gives the provinces the ability to respond to their local economic development needs.  

The candidate would have applied for permanent residence and been selected by the province or territory. The person would have expressed an interest in residing on that province and the province would be assured that such would contribute to the economic development and prosperity of the province or territory.  

Each Province or territory designs, manages, evaluates and develops their criteria for nomination in line with the Immigration law. IRCC however, has the final decision to decide if nominees meet the eligibility requirements. 

TYPES OF APPLICATION

PNP nomination process could be by:

EXPRESS ENTRY FOR PNP:

This is called Enhanced Nominations and it enables provinces or territories to increase their nomination quotas. They are processed online and usually within a period of 6 months. 

Minimum Requirements for PNP Express Entry: 
To enter into the pool, the applicant must have: 

  • Nomination that was validated by province or territory 
  • Must meet the requirements for one of the Federal Express entry programs. When submitting their online profile, the candidate will see the federal program that they are eligible for.

     

PNP Application for PR

Where an Express Entry candidate has a validated Nomination from a Province or territory:

  • They receive 600 CRS points
  • Issued with an Invitation to Apply (ITA) at the next rounds of invitations
  • Have 60 calendar days to submit an online, completed Application for Permanent Residency (APR)
  • Have met the program requirements for one of the Federal immigration programs

     

Cancelling a PNP:

If a province or territory issues a nomination and the candidate accepts, it cannot be cancelled in the candidates Express Entry.  

Cancel and Submit a new profile where:

  • The province or territory withdraws their nomination after the candidate has accepted or 
  • Candidate changes their mind about the province or territory

     

ELIGIBILITY FOR PNP :

Applicant is required to meet all of these requirements: 

  • Have the ability to be economically established in Canada
  • Named in the nomination certificate issued by province or territory
  • Intend to reside in the province and territory
  • Full time job offer in an eligible occupation (if required) 
  • Expression of Interest (may be required) 
  • Qualifications, trainings, skills, accreditations for job (if required) 
  • Legal status in country of current residence

  • Language ability ir
  • Work Experience 
  • Education and training

     

GENERAL CLASSES OF PNP:

Provinces and Territories have various streams for PNP. They are fall under the following classes:  

  • Skilled Workers
  • Semi -Skilled workers
  • Business/ investors
  • International/ Student graduate
  • Community Supported

     

APPROVING THE APPLICATION 

Applicants in Canada:

  • They will have a valid temporary resident visa.
  • The Confirmation of Permanent Residence (CoPR) is sent to their home address
  • They claim the PR status at Port of Entry or at IRCC office

     

Applicants Outside of Canada:

  • The Permanent Resident visa (if required) and the Confirmation of Permanent Residence (CoPR) is sent to their foreign address  
  • They present the PR visa at Port of Entry only

     

REFUSING THE APPLICATION 

A provincial nominee may be refused where the officer has reasons to believe that:

  • Does not intend to reside in the province or territory 
  • Unlikely to be economically established in Canada
  • Participating in passive investment
  • Withdrawal of provincial nomination 
  • For Express entry PNP, misrepresentation resulting from failure to meet claimed Federal immigration program

     

EXEMPTIONS FROM PNP:

  • Nomination from passive investment 
  • Participated or involved in an immigration investment scheme 
  • Failed or unresolved refugee claim 
  • Nominated but failed to apply for permanent residency within 6 months. 
  • Students with return obligations to their home country as a condition for their scholarship or grant
  • Caregivers
  • Seasonal workers

ADMISIBILTY

PNP Applicants must be allowed to enter Canada. 

They must not: 

  • be unable to support themselves or dependents financially 
  • be under a removal order
  • have an illegal status in Canada
  • have a criminal record
  • have a family member that is inadmissible
  • have a 5 year ban for misrepresentation from candidate or employer
  • Unauthorized work experience in Canada
